Governor Hobbs Signs Bills to Allow Casitas and Denser Housing in Larger Cities

Last week, Governor Katie Hobbs signed two bipartisan bills (HB 2270 & HB 2721) to address the need for additional housing in Arizona.

House Bill 2720 – Legalizes casitas or accessory dwelling units across the state.

House Bill 2721 – Encourages the construction of diverse types of homes instead of only single-family housing. 

The casita bill requires any municipality with a population of at least 75,000 to adopt a regulation allowing any lot with a single-family home to build at least one attached and one detached access dwelling unit. The Bill also prohibits cities from requiring additional parking, that the additional units have a similar exteriors for additional units, a kitchen, or be set back from the property line by more than 5 feet.

While this bill does not exclude using casitas or accessory dwellings as short-term rentals, Governor Hobbs indicated she hoped the Legislature would address concerns about short-term rentals and investor groups purchasing properties.
